Rooted in a desire to conduct ethical research with Indigenous People rather than on them, this autoethnographic document-based case study relies on anti-colonial praxis and places the Navajo and non-Navajo perspectives of two researchers navigating the Navajo Nation Human Research Review Board’s (NNHRRB) processes for conducting human subjects research within Kirkness and Barnhardt’s (1991) “Four Rs” framework of respect, relevance, reciprocity, and responsibility. This case analyzes and presents thematic assertions drawn from entries of both authors’ reflective journals they kept while (...) working through the NNHRRB’s process for conducting research. Evaluating the impact of clinical ethics support services remains a challenging task. 1 Against this background, we applaud the authors for developing a theoretical framework that aims to explain how repeated moral case deliberations may promote ‘practical wisdom’ in healthcare professionals and improve the quality of care in health facilities. 2 In our view, it is of particular value to draw attention to the learning processes that may be induced by ethics support services. Whether Kant’s late legal theory and his theory of race are contradictory in their account of colonialism has been a much-debated question that is also of highest importance for the evaluation of the Enlightenment’s contribution to Europe’s colonial expansion and the dispossession and enslavement of native and black peoples. This article discusses the problem by introducing the discourse on barbarism. This neglected discourse is the original and traditional European colonial vocabulary and served the justification of colonialism from ancient Greece throughout (...) the Renaissance to the eighteenth century. Kant’s explicit rejection of this discourse and its prejudices reveals his early critical stance toward colonial judgements of native peoples even before he developed his legal theory. This development of his critical position can be traced in his writings on race: although he makes racist statements in these texts, his theory of race is not meant to ground moral judgements on ‘races’ or a racial hierarchy but to defend the unity of mankind under the given empirical reality of colonial hierarchies. This article examines the organization, location, technology employed, and the price-setting strategies entertained by the olive oil mill industry in Byzantium. The methods and mechanical devices employed in the process of decorticating the olives, extraction of the oil from the pulp, and its refinement are analyzed in depth. Particular emphasis is placed on the challenges and the attendant price-setting calculus the oil press industry faced as a capital-intensive, seasonal, and topography bound activity. In monopolistic situations, the oil millers’ situational monopoly (...) was nominal compelling them to seek satisfactory rather than maximum profits, albeit likely above normal levels. In oligopolistic situations, the limited number of suppliers of the service, mutually recognized interdependence, the unpredictable outcome of confrontational pricing tactics and the ensuing costly cutthroat competition, and the fragility and illegality of collusive arrangements would tend to produce uniform and rather stable fees, albeit at levels possibly allowing for some excess profits. The state did not interfere with the oil miller’s pricing policies, appreciating the impracticality of such interventions and preferring to relegate the task to the operative market forces and the price mechanism. In this article we explore the possibility of viewing complex systems, as well as the models we create of such systems, as operating within a particular type of economy. The type of economy we aim to establish here is inspired by Jacques Derrida’s reading of George Bataille’s notion of a general economy. We restrict our discussion to the philosophical use of the word ‘economy’. This reading tries to overcome the idea of an economy as restricted to a single logos (...) or master narrative. At the same time, however, Derrida illustrates that we always operate from a restricted framework and as such something will always escape and interrupt our understanding of the world. In this paper we will propose that one could use Derrida’s reading of Bataille, along with notions such as différance, in order to move towards an understanding of complex systems as existing within certain sets of possibilities and constraints. We argue that this view of an economy agrees with the work of Edgar Morin on complexity and his conceptualization of general complexity. (shrink)

This article explores the relation between two different modes of cosmology: the social and the scientific. Over the twentieth century, scientific understandings of the dimensions and operations of the physical universe changed dramatically, significantly prompted by astronomical and astrophysical research undertaken at the Mount Wilson Observatory in Pasadena, California. Could those understandings be readily translated into social theory? Studies across a range of disciplines have intimated that the scientific cosmos might be less essential to the worlds of meaning and belonging (...) that people and communities compose around themselves than more local and relational models of an ordered whole. The article applies that proposition to the Mount Wilson Observatory itself, arguing that the observatory’s founder, George Ellery Hale, and his acolytes were deeply invested in practices of terrestrial place-making, the politics of belonging, and the cadences of civilizational time as applied to their city and its region. Moreover, they struggled to construct a philosophy integrating the cosmos they were seeking to fix at home with the contortions and careering trajectories of the universal whole. (shrink)

Amidst the constantly augmenting gastronomic capital of celebrity chefs, this study scrutinizes from a critical discourse analytic angle how Jamie Oliver has managed to carve a global brand identity through a process that is termed (dis)placed branding. A roadmap is furnished as to how Italy as place brand and Italianness are discursively articulated, (dis)placed and appropriated in Jamie Oliver’s travelogues which are reflected in his global brand identity. By enriching the CDA methodological toolbox with a deconstructive reading strategy, (...) it is shown that Oliver’s celebrity equity ultimately boils down to supplementing the localized meaning of place of origin with a simulacral, hyperreal place of origin. In this manner, the celebrity’s recipes become more original than the original or doubly original. The (dis)placed branding process that is outlined in the face of Oliver’s global branding strategy is critically discussed with reference to the employed discursive strategies, lexicogrammatical and multimodal choices. Aujourd’hui, bon nombre de philosophes des sciences ou d’universitaires semblent penser que leur expertise peut éclairer les débats publics. Le premier empirisme logique peut apparaître comme un modèle de philosophie des sciences politiquement pertinent. Dans ses travaux sur la « dépolitisation» de l’empirisme logique, George Reisch a aidé à prendre conscience de l’agenda politique (de certaines composantes) du Cercle de Vienne, agenda qui a disparu dans les États-Unis d’après-guerre, sous la pression de l’anti-communisme. L’étude du cas d’Edgar Zilsel, un (...) sociologue des sciences membre de l’aile gauche radicale du Cercle de Vienne, montre cependant que l’empirisme logique ne peut pas être considéré aussi facilement comme politique. Certes, Zilsel était un intellectuel politiquement engagé, mais il n’était pas un philosophe des sciences politiquement engagé: son intention n’était pas d’intervenir dans les débats publics ou de soutenir des causes publiques en vertu de son statut académique (il n’en avait pas) ou de son expertise professionnelle (il en avait une). Je soutiens en outre que les débats contemporains sur la place de la science dans la société, menés par des universitaires qui, soucieux de leur impact sur les questions de société, conceptualisent l’influence sociale en termes de motifs et de valeurs individuels, ne correspondent pas au point de vue des empiristes logiques de gauche: ceux-ci cherchaient à fournir une explication sociologique de la science et s’attachaient davantage aux déterminants structuraux qu’aux motifs individuels. Ainsi, même si l’empirisme logique peut être vu comme un modèle de philosophie des sciences politiquement pertinent, il pointe, à mon sens, dans une direction différente de celle généralement prise par ses héritiers d’aujourd’hui. Here is the final volume of Norman O. Brown's trilogy on civilization and its discontents, on humanity's long struggle to master its instincts and the perils that attend that denial of human nature. Following on his famous books _Life Against Death_ and _Love's Body_, this collection of eleven essays brings Brown's thinking up to 1990 and the fall of Communism in Eastern Europe. Despite the outpouring of interest in tort and criminal theory over the last thirty years, not much progress has been made toward understanding the basic concepts for analyzing liability. Common law theorists of torts and criminal law tend to accept the conventional distinction between objective and subjective standards and the view that objective negligence is not really fault in the way that subjective negligence is. The author’s view is that this distinction between objective and subjective standards is misunderstood and that, (...) in fact, so-called objective negligence is a test of fault or culpability in the same way that subjective standards are. This paper seeks to defend inadvertent negligence as a proper basis for blaming someone for causing harm, whether in the context of tort law or criminal law, whether the standard is regarded as objective or subjective. The first part of the paper, the historical part, engages in an extended analysis of Oliver Wendell Holmes’ writings on negligence. The second part of the paper, the philosophical part, addresses the general question of how people can be considered at fault and be blamed for not knowing critical attributes of their conduct, which might be either matters-of-fact or matters of moral evaluation. Cet article a pour but de montrer la proximité importante de deux auteurs, a priori très différents, au sujet de la question de la santé et de la maladie : Georges Canguilhem et Oliver Sacks. Ils se sont tous deux efforcés de critiquer une conception naturaliste et objectiviste de la santé et de la maladie, le premier en forgeant et en travaillant le concept de norme vitale, le deuxième en décrivant des patients atteints de troubles neurologiques. Ils se rejoignent (...) pour soutenir que la maladie n’est pas une réalité antinaturelle ou aberrante, mais une façon de vivre, une forme d’équilibre physiologique. Toutefois, leurs façons de concevoir la santé vont s’avérer très différentes, pour ne pas dire antinomiques. Canguilhem se reconnaît très influencé par Nieztsche : la santé, c’est la grande santé, la capacité à surmonter les maladies et les épreuves. Il s’ensuit un dualisme entre les héros de la grande santé et la vie plus faible et plus fragile de tous les autres, un dualisme que Sacks remet radicalement en cause lorsqu’il montre que la maladie est aussi une expérience qui nous ouvre à des possibilités nouvelles. Le dialogue qui peut s’ouvrir entre ces deux penseurs permet de problématiser des enjeux essentiels de la question de la santé et de la maladie. (shrink)

Foreword by Oliver Sacks Kurt Goldstein (1878-1965) was already an established neuropsychologist when he emigrated from Germany to the United States in the 1930s. This book, his magnum opus and widely regarded as a modern classic in psychology and biology, grew out of his dissatisfaction with traditional natural science techniques for analyzing living beings. It offers a broad introduction to the sources and ranges of application of the "holistic" or "organismic" research program that has since become a standard part (...) of biological thought. Goldstein was especially concerned with the breakdown of organization and the failure of central controls that take place in catastrophic responses to situations such as physical or mental illness. But he was equally attuned to the amazing powers of the organism to readjust to such catastrophic losses, if only by withdrawal to a more limited range that it could manage by a redistribution of its reduced energies, thus reclaiming as much wholeness as new circumstances allowed. Goldstein's theses in The Organism have had an important impact on philosophical and psychological thought throughout the twentieth century, as evidenced in the work of Maurice Merleau-Ponty, Georges Canguilhem, Ernst Cassirer, and Ludwig Binswanger. A recent conference at University College, London, confirms this observation, but readers (...) of this journal had some time before witnessed an encounter between Edwin Curley, University of Michigan, and A. P. Martinich, University of Texas, which laid out lines of argument that continue to figure in the debate. When two highly accomplished and learned philosophers divide on fundamental points, the result must be of interest. But here the theme itself also compelled attention: Hobbes's theology. Had these dry bones risen? If so, could the dancing angels be far to seek, and what then of the filioque? While there were gestures of accommodation and agreement throughout the exchange, the essentials that divided the two at the beginning largely remained at the end. What assumptions underlay this disagreement and determined its rather unsatisfying conclusion? In answer, I would draw the reader's attention to the peculiarities of the contested concept, that of authorial sincerity: Martinich tenaciously ascribing it to Hobbes's theologus; Curley steadfastly withholding..
